Terms and Conditions (T&C) for FAM YAZILIM İÇ DIŞ TİCARET ANONİM ŞİRKETİ
Scope
The following Terms and Conditions (T&C) govern the use of the software and internet solutions provided by FAM YAZILIM İÇ DIŞ TİCARET ANONİM ŞİRKETİ (hereinafter referred to as “the Company”) by registered companies (hereinafter referred to as “Customers”) within the scope of the MarketCheck product. By using the services of FAM YAZILIM İÇ DIŞ TİCARET ANONİM ŞİRKETİ, Customers accept these T&C. Deviating conditions of the Customers shall only apply if expressly agreed upon in writing by the Company.
Service Description
The Company offers a diverse range of software and internet solutions, including the MarketCheck product. MarketCheck is a free app that can be downloaded from both the iOS App Store and the Android Store. The app allows Customers to create their own company profiles and publish information about their businesses. In addition to general information, Customers can also specify the products they sell and their respective locations for display on the map. They also have the option to upload brochures and leaflets. End customers, i.e., consumers, can view this information and provide reviews for the businesses.
Registration and Profile Creation
To create a profile in the MarketCheck app, Customers must register through our browser application. Registration is completed by providing the necessary information, which is then verified by the Company. Customers are obligated to provide accurate and complete information during the registration process. After successful registration, Customers can make adjustments to their profiles.
Responsibility for Profile Content
The Company merely provides the platform and technical capabilities for Customers to create their company profiles and publish information. The Company assumes no responsibility for the content published by Customers in their profiles. Customers are solely responsible for the accuracy, completeness, and legality of the provided information. The Company shall not be liable for any damages or losses arising from the content of Customer profiles. It is the Customers’ responsibility to ensure that their profiles comply with applicable laws and regulations and do not infringe upon the rights of third parties.
Presentation of Offers
All offers displayed on the platforms are not legally binding offers but merely information to facilitate shopping with the respective providers. Therefore, no purchase or other contracts for the acquisition of the displayed products or services are concluded on the platforms. The Company assumes no guarantee for the availability, quality, accuracy, or legality of the presented information and shall not be liable for any damages or losses resulting from the use or reliance on this information.
Premium Packages
The Company offers Customers premium packages that can be purchased to access additional services. The exact services and prices of the premium packages are detailed in the product descriptions. Possible services include, for example, the ability to create brochures directly within our web application or request professionally designed brochures for an additional fee.
Data Protection
The Company is committed to complying with applicable data protection regulations. Information on the collection, processing, and use of personal data can be found in our Privacy Policy.
Limitation of Liability
The Company shall only be liable for damages caused by willful intent or gross negligence on the part of the Company. Any further liability is excluded.
Final Provisions
These T&C are governed by Turkish law. Izmir, Turkey, is agreed upon as the exclusive place of jurisdiction for all disputes arising from these T&C. If any provisions of these T&C are or become invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by a legally permissible provision that comes closest to the economic purpose of the invalid provision.
